With this being such a crucial year for West Papua, we have put
together a West Papua activist kit that people around the world can
download from their computers and take action to spread awareness
about the ongoing atrocities an crimes against humanity being
committed by the Indonesian authorities in West Papua, as well as
developing support for the Papuans right to self-determination.

The kit includes pint ready posters and flyers. We are asking you to
print off copies and circulate these as far and wide as possible
(schools, workplaces, universities, cafes, community centres etc).
Included in this download file are:

- - A sign up letter including background information about IPWP for
you to pass onto your local member of parliament asking them to join
IPWP
- - Three different A3 size posters calling for the release of Papuan
political prisoners, a re-run of the Act of Free Choice, and
information on the human rights violations that have been committed
against Papuans over the years by Indonesian authorities.
- - Three different A6 postcard size flyers including ones that you can
send to the Indonesian Ambassador in your country.

Dear friend of West Papua

In this update we bring you news of the recent launch of
International Lawyers for West Papua (ILWP), news updates on the
trials of Sebby Sambom and Buchtar Tabuni, and confirmation of the
next date for our twice monthly demonstrations outside the
Indonesian Embassy.

*** LATEST NEWS FROM WEST PAPUA ***

- - Last week Indonesian authorities expelled the 'International
Committee of the Red Cross' from West Papua. In addition to this
there has been a massive increase in military numbers being sent to
West Papua in recent weeks, raising fears that Indonesia are
planning further widespread sweeping operations against the
indigenous population. (*please contact your local member of
Parliament to express your deep concern at these developments*)

- - The trial of Sebby Sambom started earlier today (6th May) in
Jayapura. He faces a 20 year jail sentence for his part in a
peaceful demonstration held in Jayapura last October in support of
the launch of International Parliamentarians for West Papua (IPWP).
In January, Sebby was denied food and water for over 3 days whilst
in custody, and has been badly tortured during interrogation by the
police.

- - The trial of Buchtar Tabuni is still ongoing. He is also on trial
for his part in the peaceful demonstration supporting IPWP. Last
month Buchtar was bound and beaten by police and court officials in
Jayapura court house after asking to speak with his legal team
before proceedings began.

- - Over 10,000 people took to the streets of Nabire to show their
support for the launch of 'International Lawyers for West Papua',
with similar gatherings reported across the rest of the country.
Indonesian military opened fire on the peaceful procession, killing
several people and wounding many others including a 7 year old boy.

*** LAUNCH OF INTERNATIONAL LAWYERS FOR WEST PAPUA ***

West Papuan independence leader Benny Wenda recently returned to the
UK after spending 3 weeks in South America and the Caribbean region
for the launch of International Lawyers for West Papua (ILWP).

The launch took place in Guyana, South America. In 1969 Guyana
supported West Papua's right to self-determination, and at the
launch Government ministers re-affirmed their country's support for
West Papuan self-determination. A number of international lawyers
led by Melinda Janki also gathered for the launch. In Guyana, Benny
Wenda also met with the British Consulate.

Following this, Benny travelled to Trinidad and Barbados where he
undertook meetings with Government officials from across the
Caribbean region, developing support for both ILWP and IPWP. He also
gave a guest lecture to university students at West Indies
University in Barbados, telling them about the plight of the West
Papuan people.

A new website for ILWP has just launched ( www.ilwp.org). We are
happy to announce that there will be a further launch for
International Parliamentarians for West Papua (IPWP), taking place
in the European Parliament this September.

*** THE LANI SINGERS ***

Benny and Maria Wenda of the Free West Papua Campaign perform
traditional music as the Lani Singers, spreading awareness of the
plight of the West Papuan people and their desire to be free.

A new website has recently been launched for the Lani Singers
(www.thelanisingers.com). As well as indepth information about them,
you can also listen again to their previous interviews and sessions
on BBC Radio 3 and BBC Radio London.

This summer they will be performing at events including the Port
Eliot Festival in Cornwall and the Tribal Film Festival in Czech
Republic (where there will also be a launch of the Czech 'Free West
Papua Campaign').

We will be holding our next demonstration outside the Indonesian
Embassy in London next Thursday, 14th May from 12 till 3pm. Please

Manokwari: National Youth Committee holds seminar to discuss makar
and separatism

The National Committee of the Youth of Papua (KNPP) plans to hold a
seminar in order to try to understand what the authorities mean by
the words 'makar' and 'separatism', bearing in mind the many
questions being raised about these terms.

Among those invited to attend the seminar and submit documents were
the chief of police, the chief prosecutor and the chairman of the
district court but none of these agencies have responded so far.

The chairman of the KNPP John Warijo told journalists that the
seminar will last for two days in order to try and understand what
these words actually mean. He explained that they have been used as
threats against the Papuans whenever they raise demands for their
basic rights.

The stigma of 'makar' (subversion) is constantly being used to
discredit Papuan people, as a result of which many efforts to raise
issues about their rights have been hindered.

He said that they hope that an agreed understanding could be reached
between the people of Papua and the security forces in order to
ensure that Papuans are not continually victimised whenever these
words are used.

'We very much hope that they will come and help to explain what this
all means,' said Warijo.

Manokwari, Media Papua

The chairman of the Bird's Head branch of the Dewan Adat Papua,
Barnabas Mandacan, who has been declared a suspect and charged with
makar in relation to a peaceful demonstration held on 1 December
2008 has been asking about the attitude of the police with regard to
this case.

Following his interrogation as a suspect several months ago, the
matter has not yet been resolved. Both the chairman of DAP and John
Warijo are facing charges for makar.

Mandacan told this newspaper that he still doesn't understand why he
has been declared a suspect. He does not feel that he did anything
subversive on the occasion of the demonstration on 1 December 2008.
All he was doing was drawing attention to the aspirations of the
community. He is particularly concerned also by the fact that
nothing has yet been done to process the case. because it has
constantly been postponed.

He very much hoped that the police and the prosecutor's office would
attend the seminar planned by the KNPP to explain what they means by
makar and separatism.

He went on to say that if these authorities failed to turn up and
provide the explanations requested, then he would not respond to the
summons he has received from the police. 'I will draw the conclusion
that if the police fail to turn up, that means that my case has been
closed, because I fail to understand what they mean when they use
these words.'

Media Papua, 6 May 2009 John Warijo declared a suspect for
involvement in 1 December demonstration.

In response to the decision of the police to declare him a suspect
for attending a demo on 1 December 2008, John Warijo, the chairman
of the KNPP said that such a charge should not be made against him.
He was speaking to journalists during a break in a recent seminar.

When planning the seminar, they had made a point of inviting the
police and the prosecutor's office to come along and explain what
they mean by makar and separatism. In view of their failure to turn
up, he too will not respond to any summons from the police.

The event on 1 December 2008 consisted of a Long March held to
commemorate the declaration of West Papua independence. A few months
later, he along with the chairman of the local DAP were declared as
suspects.

They are both amazed by this development bearing in mind that during
the Long March, no Morning Star flags were flown. All they were
doing was to draw attention to their aspirations.

A coalition of some of the world’s biggest pension fund investors
from Europe and the U.S. is campaigning to persuade shareholders in
Freeport-McMoRan Copper & Gold Inc., the U.S.-listed copper producer
– the largest in the world – that the company should clean up its
controversial pollution record by appointing an environmental expert
to its board.

The five New York City Pension Funds have joined forces with APG,
which manages the €173 billion ($235.8 billion) assets of the Dutch
ABP pension fund for civil servants, the Swedish government AP
pension buffer funds and the General Board of Pension and Health
Benefits of the United Methodist Church in the U.S., to put the
proposal on the ballot at Freeport’s June 11 annual general meeting
in Wilmington, Del.

The investors are going head-to-head with Freeport’s board of
directors, which has unanimously recommended that shareholders
oppose the motion. Freeport said: “As a corporate governance matter,
our board does not believe that it is in our shareholders’ best
interests to require a particular type of specialist on our board.
We believe that our board of directors represents a diverse group of
individuals with broad experience in geology, business, finance,
international relations and public affairs.”

The company’s environmental record has been a regular target of
institutional investor ire. In 2006, the huge Norwegian Government
Pension Fund blacklisted the company over its disposal of waste
residue into a local river at its Grasberg mine in West Papua,
Indonesia. Investors say the practice is illegal in many countries.
Earlier this year, the Norwegian fund also pulled €551 million in
investments from Rio Tinto, the London-listed international mining
group, because of a joint venture with Freeport at the Grasberg mine.

In the latest campaign, the Freeport investors say the company has
been slow to issue what they consider to be full information on its
assessment and monitoring of environmental and health risks
associated with the residue disposal at Grasberg. The funds say this
is damaging to their interests as shareholders because of risks that
the company’s environmental performance falls short of
internationally accepted standards leading to difficulties in
accessing capital for new projects and obtaining necessary
regulatory licenses. Freeport says it has consistently met
internationally acceptable standards for environmental management.

The investors said: “We believe it could be highly beneficial for
the company to address the environment at the most strategic level
in the same way that it has addressed human rights – in other words,
to appoint an appropriate specialist to the board. We envisage a
board director whose background combines acknowledged environmental
commitment and expertise with leadership experience in a business or
other appropriate context. This appointment would place Freeport at
the forefront of board-level practice on environmental and social
issues in the mining industry.”

The investors hope to mirror the success of a 2005 campaign led by
institutions including the New York City pension funds that was
critical of Freeport’s human rights practices and links with the
Indonesian military. Freeport subsequently commissioned the
independent International Center for Corporate Accountability at
City University, New York, to carry out two audits of Grasberg and
appointed Judge Gabrielle McDonald as a director and special counsel
on human rights. The investors say Freeport appears to have
responded positively and transparently on human rights.

INDONESIA: Indigenous Papuans are shot by police and denied proper
medical treatment

ISSUES: Police assault; detainees' right to medical treatment; excessive

Dear friends,

*The Asian Human Rights Commission (AHRC) has learned that two
indigenous Papuans have died and three others have been injured
after the unrestrained use of lethal fire arms by the Mobile
Brigadier (Brimob) Unit of Papua Regional Police on 9 April 2009 in
Abepura, Papua, Indonesia. The wounded were arrested and taken to a
hospital, but reports allege that they did not receive proper
medical treatment, resulting in the death of one.

CASE DETAILS*: /(based on facts gathered by local NGOs) /

On Thursday 9 April 2009, the day of the legislative elections in
Indonesia, several security posts had been set up along the road in
Abepura, Papua, to safeguard the electoral process. According to
reports an unknown group of about 100 indigenous Papuan people
gathered and approached the Abepura Circle, shouting protests. Seven
members of Mobile Brigades of the National Police (BRIMOB) were
watching over the election booths (TPS) with other local officers
and opened fire directly into the crowd, from about 70 metres away.
The protestors ran westwards but one unknown man was killed onsite
and four more were injured. The police arrested five from the group,
and while leaving the scene the remaining protestors, clearly
distraught, burnt three motorcycles parked in Sekolah Street.

One victim, Erik Logo, sustained a bullet wound to the left side of
his stomach and was taken to the Dok II Jayapura District Hospital
(RSUD) that same afternoon. It is reported that the bullet was
removed in surgery that evening, but neither religious
representatives nor human rights activists were allowed to visit him
in the hospital despite concerns about his treatment there. On April
22 he died at the hospital and access to his corpse was denied.

Among the other five arrested protesters, Johny Hisage and Kanitius
Hisage were not reported to have been injured; Yance Yogobi’s left
shoulder was wounded; Dini Agobi sustained injuries to his right
knee and Andi Gobay, to his left ankle. The three wounded arrestees
were brought to the same district hospital one day later on April
10. It is reported that Yance Yagobe remained handcuffed until his
surgery a week later (on April 17) and that no one was allowed to
visit him, including his family.

Despite being informed that a protest would take place in Abepura on
April 9, the police took no apparent steps to diffuse the situation
– which they have since described as an attack – peacefully, nor did
they apply any measure of caution to the protestors. The excessive
use of rapid gunfire resulted in two men dying, and has heightened
the great tension that already infuses the election period in Papua.

*BACKGROUND INFORMATION: *

Several incidents of violence and protest in West Papua were
reported during April 2009, including killings, arrests and the
discovery of bombs in several places. However there is no evidence
available to support the media reports, which blame the Free Papua
Movement (OPM). Preliminary investigations on the ground point
instead to third party players who could benefit from instability in
West Papua.

Religious leaders and human rights activists have been striving to
ease the increasing polarisation between indigenous Papuans and
transmigrants from other parts of Indonesia. While the public is
suffering from unpredictable security conditions, the security
forces, including the military, appear to be playing a disturbing
and ambiguous role, rather than addressing the tensions. While their
actions do maintain public order at times, unnecessary violence in
numerous other cases has stirred up anxiety and aggression in the
public, which has become a major theme in the nationwide elections.
Indonesians worry that April’s incidents were arranged to serve
political agendas in the ongoing election campaign in the rest of
the country.

I am writing to express my deepest concern regarding the excessive use
of force allegedly committed by police in Papua. Based on information I
have received, on 9 April 2009 seven Brimob officers shot at group of
about 100 indigenous Papuans, who appeared at Lingkaran Abepura,
shouting in protest. Instead of using non-lethal means to keep order
during the election period, the mobile brigades (Brimob) opted for
lethal gunfire. This dispersed the group, however one person was shot to
death and another named Erik Logo died in hospital on April 22 from a
bullet wound in his stomach. Three others were wounded: Yance Yogobi was
shot in his left shoulder, Dini Agondi was wounded in his right knee and
Andi Gobay sustained injury to his left ankle.

The victims were taken to Dok II Jayapura District Hospital but none
were allowed visitors, including from their family, until after surgery
had been performed days later. Yance Yogoby was handcuffed throughout
the week leading up to his delayed surgery. Although they were taken to
hospital, according to the information I have received, the victims were
not well medicated or card for--they were not provided with a change of
clothes for almost a week, when hospital staff urged the police officer
to allow the patients better care. Two of the five detainees, Johny
Hisage and Kanitius Hisage were reportedly uninjured.

I would like to remind you that according to Article 3 of the UN Code
for Conduct Law Enforcement Officials, law enforcement officials may use
force only when strictly necessary and to the extent required for the
performance of their duty. It is also stated in number 13 of the UN
Basic Principles for The Using of Force and Firearms by Law Enforcement
Officials that "in the dispersal of assemblies that are unlawful but
non-violent, law enforcement officials shall avoid the use of force or,
where that is not practicable, shall restrict such force to the minimum
extent necessary".

Therefore, I strongly urge you to ensure that this case is impartially
investigated, and that all perpetrators shall be taken into account.
Abandoning such a case will simply strengthen the culture of impunity in
Indonesia, which I sincerely hope is not your wish.

Finally, regarding the insufficient treatment given to the victims, let
me remind you that as a State Party of the International Covenant on
Economic, Social, and Cultural Rights (ICESCR), Indonesia must ensure
that everyone in its territory--including detainees--has the right to an
attainable standard of physical and mental health, as enshrined in
Article 12. Article 8 paragraph one of the Minister of Justice
Regulation Number M.04-UM.01.06 Year 1983, also specifically states that
detainees have the right to access proper medical treatment. You will
also find under the Body of Principles for the Protection of All Persons
under Any Form of Detention or Imprisonment adopted by General Assembly
resolution 43/173 in 1988, that Principle 24 enshrines the right of
detained persons to a prompt and proper medical examination and any
resulting necessary care, whenever necessary, while Principal 19 states
that every detainee has the right to “be visited by and to correspond
with, in particular, members of his family and shall be given adequate
opportunity to communicate with the outside world.”

Thus I urge you to investigate the excessive use of lethal force,
resulting in the immediate death of one person, the later death of
another and the injury of three more protestors; and the alleged lack of
sufficient medical treatment of the injured persons while in police
detention. This investigation must include the death of Erik Logo while
in custody, and in particular his delayed surgery.

Pemekaran Provinsi

Dalam sambutanya Bupati A.P.You mengatakan bahwa akan dimekarkan Tiga Kecamatan dalam tahun ini, dan akan di bentuk dan diresmikan Pemekaran Kabupaten Dogiyai sebagai Busur Panah Jitu artinya sebagai kabupaten penentu terbentuknya Provinsi Papua Tengah, dan Dia tidak mematuhi Keputusan Pemerintah Daerah Provinsi Papua yang Membatasi segalah Pembentukan dan Pemekaran Papua dimulai dari pemekaran Kecamatan, Kabupaten Provinsi. Dia pun juga menjanjikan Masyarakat Nabire akan di bagi bagikan Uang tiap-tiap desa Rp 100 Juta, untuk membujuk dan memadam kekhawatiran segalah pemekaran daerah ini.

Pada saat Pelantikan Bupati dan Wakil Bupati Paniai Gubernur Bas Suebu juga Mengatakan bahwa Pemekaran Propinsi Papua Sudah Ditundah dan Hanpir tidak akan diadakan Pemekaran lagi sebab Dana Otonomi Khusus Papua 90% Hilan di Birokrasi Sedangkan yang menikmatio Oleh Rakyat Papua adalah Hanya 10% Dari dana yang di kucurkan Oleh Pihak Luar Negeri Lewat Jakarta itu. 

Dia juga mengatakan bahwa di Papua Hanya 2 juta jiwa lebih saja tidak bisa mensejahterahkan, di banding Pulau Jawa yang sekian Melebihi Berlipat ganda penduduk saja sudah penganggurannya berkurang. Sedangkan kaum pekerja di papua saat ini di perkirakan 20% selebihnya itu nganggur begitu saja. Artinya pemekaran /Otsus/MRP bukanlah suatu solusi namun menambah Persoalan semakin Rumit.

Yang Masyarakat Butuh Saat Ini

Yang kami Masyarakat butuh saat ini adalah bukan pemekaran tapi pembangunan, Pemberdayaan, Kepedulian, Perhatian untuk mengankat harkat dan martabat masyarakat pribumi setempat.

Pandangan Masyarakat Papua selama 42 tahun Papua di Pangkuan RI

Daerahku adalah Hanyalah Sampah NKRI, Masyarakatku adalah Masyarakat yang Tertinggal Jauh dari Perkembangan Jaman Globalisasi Dunia dan Bangsaku adalah Bangsa Yang dilupakan oleh NKRI dan PBB serta bangsa –bangsa lain di dunia. 

NKRI telah lama menisolasikan Negeriku dengan Saudara-saudara sebangsa Seras sewarna Kulit Melanesia di pacific. Sesungguhnya saya adalah bangsa Pasific bukan asia. Saya Tidak Mengerti Orang-orang Papua yang menjadi Hamba Uang dan Jabatan bagi NKRI dan Mereka ingin mau menerima itu atas dasar Paksaan/Keterpaksaan padahal Orang Papua sudah dengan sesungguhnya Tolak OTONOMI KHUSUS PAPUA, PEMEKARAN, MRP itu dll. Kenapa ? Orang Papua sendiri tidak mau bekerja untuk diri kita sendiri. Mari kita bersatu dan perjuangkan kemerdekaan Papua. 

Pesan saya Pejabat Pribumi Papua Jangan anda buta dengan Uang dan Jabatan Tapi lihatlah Bangsamu, Negrimu, Warna Kulitmu, Rambutmu, sebab sesungguhnya Masalah Rasisme sudah di Hapus di dunia termasuk NKRI-PAPUA. Kepunahan Orang Papua adalah Pembantaian Ras Melanesia selama 42 tahun Papua berada di Pangkuan NKRI/IBU PERTIWI INI. Mr Ambassador

When the BBC recently broadcast their special undercover report about West Papua (http://www.engagemedia.org/Members/fPcN_interCultural/videos/WP_highlands-BBC2_Xvid_720x576-egmed.avi/view), your embassy gave a statement stating that nobody is immune from prosecution for human rights abuses committed in West Papua. You also claimed that Indonesia is a mature democracy that should not be 'judged on old yardsticks'.

The BBC tell us that despite their requests, they have still received no evidence from you to suggest that any members of the Indonesian security forces have been held accountable for human rights abuses committed in West Papua since the occupation began. We also understand that since the program, there have been renewed efforts by the Indonesian security forces to find General Goliath Tabuni and members of the OPM, resulting in the deaths of many Papuan women and children. These reports are currently being investigated by the UK Foreign Office.

Today, in this open letter (of which we are also sending a copy to the BBC, Channel 4 News, the UK Foreign Office, Human Rights Watch and Amnesty International), we challenge you to show that your claims that Indonesia is a mature democracy and should not be judged by old yardsticks are true. If you fail to respond to this letter then it will be clear that you were lying to the BBC.

We challenge you to explain the following:

Why has there has been no follow-up regarding the shooting dead of tribal leader Opinus Tabuni, who died during an event to commemorate the anniversary of the United Nations indigenous people's day on 9 August 2008 in Wamena?

If Indonesia is a 'democracy' as you so claim (in which freedom of speech and expression should surely be a central facet), then why are people put in prison for 15 years for raising the West Papua flag?

Why are two Papuan men Sebby Sambom and Buchtar Tabuni currently on trial for peacefully supporting the launch of International Parliamentarians for West Papua? Surely if they have done wrong then you should also be seeking the extradition of British politicians who set this parliamentary group up including Andrew Smith, Lembik Opik and Lord Harries.

Why did prison officials refuse food and water to Sebby Sambom, Buchtar Tabuni and several other prisoners for over 3 days in January of this year? What action has been taken to hold the prison officers to account?

In light of the report from Human Rights Watch stating that torture and abuse are widespread at Abepura Prison in Jayapura, what steps are being taken to hold those prison officers to account? Which prison officers will be disciplined for abuse?

Why is the Amnesty International prisoner of conscience Yusak Pakage being held in a narcotics prison and being subject to inhumane levels of torture?

Why has your government expelled the International Committee for the Red Cross from West Papua, and at the same accelerated the build up of troops in the region everyday.

Why are cases of rape, torture, intimidation and killings not acted upon by your government? How can you ever expect the Papuan people to trust your regime after all the suffering you have borne upon us?

It is very much in your interests to make an official response to the questions laid forth in this letter, otherwise it will be clear that you lied to the BBC in your statement on Newsnight, and this will be exposed on future news programs that are currently planning exposes on the reality of life in West Papua and their determination of all Papuans to be free.

INDONESIA: New police regulations but still no criminalization of torture

On June 25, 2009 Indonesia's new police regulations will come into effect, just one day before the UN International Day in Support of the Victims of Torture this Friday, June 26. While the new regulations are a steppingstone to the long-awaited police reforms in Indonesia, the key to end the prevalent practice of torture is to criminalize the act itself as required by international standards. However, that requirement is still lacking and this allows torture to go unpunished, even with the new regulations.

Indonesia signed the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment in October 1998 but even during the last review of the countries implementation of its commitments by the UN Committee Against Torture it was found that serious shortcomings and legal gaps have not been addressed by the legislators.

However, the new police regulation refers to torture in ten different articles (article 5, 7, 10, 11, 13, 23, 24, 37, 38.2, 41) covering the prohibition of ordinary torture, the use of sexual torture in particular (article 13(a)) and even prohibits torture in cases of state of emergencies in article 41. Article 10(e) of the regulation requires that officers or personnel of the national police "refrain from instigating or tolerating any act of torture or other cruel, inhuman or degrading treatment or punishment, nor may any law enforcement official invoke superior orders or exceptional circumstances such as a state of war as a justification of torture".  Article 11(b) then continues to state that the police "shall not commit () torture" of detainees or crime suspects, which remains a widespread phenomenon as recent cases received by the AHRC show.

The relationship between the right to fair trial and torture as part of police investigations is acknowledged in Article 37, which requires that the national police "must not" make use of torture. The document titled Regulation of the Chief of the Indonesian National Police, No. 8/2009 regarding the implementation of human rights principles and standards in the discharge of duties of the Indonesian National Police can be downloaded in a full English version here from the AHRC's Indonesia website.

While the new regulations are a key development in the countrys human rights protection, the act of torture is still not a crime. That means that police officers using torture can still not be held accountable for torture in a court of law and be punished with imprisonment, as is common in other countries and required by the convention Indonesia ratified more than 10 years ago.

In April 2009 two cases of torture lead to the death of the victims. Mr. Bayu Perdana Putra was reportedly tortured in the North Jakarta Police station and Carmadi, another victim, died during his detention at the Tegal area police on Java as a result of the torture he had to endure. In another case, Mr. Zaenal M. Latif was lucky and survived the torture he had to endure in the Cilegon police station. As so often, also in these cases the policemen did not even wear their uniforms when conducting arrests.

These cases from Java are the tip of the iceberg as most cases are not even reported due to the intimidation victims are subjected to by the perpetrators. In particular, suspects of crimes or other illegal acts receive a "punishment" by the police even before an investigation takes place and their guilt was proven before a court in a fair trial. How can this be called justice?

Torture is particularly rampant in crisis regions such as Papua were political prisoners have been reported to have repeatedly subjected to torture. But not only political prisoners suffer from police or military torture. It is mostly the ordinary public, in particular the poor, who become the first targets of security forces. In Papua, where major parts of economic and civilian life are subjected to control of the military in a power struggle against the police the, violence by security forces against civilians is systemic.

Many rights groups in Jakarta and other regions in Indonesia are planning to launch demonstrations and voice their continued demands on the coming day against torture on Friday: Make Torture a Crime! The AHRC is of the view that what Indonesia requires most is the review of its outdated Penal Code in order to make torture a crime and an end to the militarization of the remote areas of the country such as the provinces Papua and West Papua.

The Indonesian police carry out widespread abuse with impunity against criminal suspects and poor and marginalized communities, according to a new Amnesty International report published on Wednesday.

The report, Unfinished Business: Police Accountability in Indonesia , reveals the torture and ill-treatment of criminal suspects, repeat offenders, drug users, and sex workers during arrests, interrogation and detention.

The report also details numerous cases of excessive force being used against suspects, sometimes leading to fatal shootings. These abuses are rooted in a culture of impunity and the perpetrators are rarely brought to justice.

The report shows how widespread the culture of abuse is among the Indonesian police force, said Donna Guest, Amnesty Internationals Asia Pacific Deputy Director. The polices primary role is to enforce the law and protect human rights, yet all too often many police officers behave as if they are above the law.

The report acknowledges the changes the government of Indonesia has introduced to regulate police conduct and to introduce greater accountability in police codes and practices, but these changes have failed to stamp out cases of physical abuse and intimidation.

Amnesty International spoke to scores of victims of abuse and others including police officials, lawyers and human rights groups in Indonesia over the last two years. The organization found that drug users, repeat offenders and women including sex workers were particularly vulnerable to abuse. Many of those interviewed said police officers attempted to extract bribes from them in return for better treatment or a reduction in sentencing.

Internal disciplinary mechanisms set up by the police are unable to deal effectively with complaints about police abuse, according to the report. Victims usually do not know where to report abuses and are vulnerable to further abuse if they make a complaint directly to the police. The report also illustrates how current external police oversight bodies do not have  adequate power to bring to justice those responsible for abuse.

At a time when the government of Indonesia and senior police figures have made the commitment to enhance trust between the police and the community, the message is not being translated into practical steps on the ground, said Donna Guest. Too many victims are left without access to real justice and reparations, thus fuelling a climate of mistrust towards the police.

Amnesty Internationals report called on the government of Indonesia to acknowledge publicly that police abuse is widespread and initiate prompt, impartial and effective investigations into every credible report.

The organization said that those found responsible must be brought to justice and victims granted reparations. It also said that, in order to make these changes, the government should review the internal system for submitting and processing complaints of police abuse to ensure that investigations into police misconduct are prompt, impartial and independent.

Amnesty International also called on the government to establish an independent police complaints mechanism to receive and deal with complaints from the public.

Dear friends,

The Asian Human Rights Commission (AHRC) has received information that a man who was shot dead by police while in custody was not trying to escape at the time, as the police have suggested. The victim, who was arrested on April 2, 2009 by police officers in North Jakarta and was pronounced dead on April 4, reportedly had at least ten stab wounds to his legs when he was shot, along with other injuries. The case suggests a halfhearted cover up of torture and execution on various levels within the station, which has not yet been legally addressed.

CASE DETAILS: (According to the victim's family)

On April 2, 2009 at 2pm Mr. Munadi received a phone call from his daughter-in-law Ade Nur, telling him that his son had been taken away by six or seven people who claimed to be officers for the North Jakarta police force.

Munadi went straight to the North Jakarta police station after the call, but was told that no one had been detained from the Galur area of Cempaka Putih that day, where his son Bayu Perdana Putra had been. Munadi inquired at two neighboring police offices but was told the same thing. He returned to the North Jakarta police station at 5:15pm, but there was still no word.

At 11pm Munadi received another call from Ade Nur; the police had returned she said, and ransacked the couple's rented room. They didn't find anything and one officer left his number with Ade Nur (021-97301867) so Munadi called it and, to get through, pretended to be a friend of the policeman. But when the officer took the call Munadi says he heard his son screaming for mercy in the background. Munadi asked who was screaming and asked the police to stop harming them; the officer pretended not to hear and hung up. Five minutes later the officer called back and asked who the caller was, and when Munadi explained that he was the father of Putra the officer hung up again.

Munadi went straight back to the station (at around 11:30pm) and went to the fourth floor to meet with those in the office of the second highest detective in command, Mr. Santoso. Munardi recounted what had happened that day and asked after his son, and an officer looked into it and told him that Bayu was being held in Bogor, West Java. Munardi went home.

On April 4 at 3pm Munardi got a phone call from Ade Nur, who told him that Bayu had been pronounced dead in CM Hospital from two gunshot wounds to his chest and stab wounds on both his legs. It is not clear on which day he had died.

Meeting with Santoso, Munadi was told that Bayu had been shot by the police after he tried to escape during a crime scene reconstruction. Yet in the hospital later that day he found his son's corpse covered with other wounds, including gaping wounds on his wrists and hands and more than 10 stab wounds on his legs. They were not wounds, he says, of a man who would be able to run away.

Despite phone calls and visits to the police station, Munadi was unable to get anyone to help him with the release of the body from the hospital. On April 5 around 11am an officer finally arrived from the police station to arrange their collection of the body, which the family buried in their village in Cirebon, West Java.

SUGGESTED ACTION:

Please write to the local authorities listed below to demand an immediate investigation into the operation of police at the North Jakarta Police Station and in Bogor, West Java, with due disciplinary and legal action taken against those found guilty of participation in the torture, murder and the following cover up. Please ask for the intervention of the National Human Rights Commission and the National Police Commission to ensure that the victims family receives proper redress and compensation.

Please also be informed that the AHRC has written a separate letter to the UN Special Rapporteur on the question of torture and on extrajudicial, summary or arbitrary executions, calling for an intervention in this case.

I am writing to voice my deep concern regarding an incident of torture involving the North Jakarta Police. Bayu Putra Perdana was arrested on April 2, 2009, though his family were not told where he was being held. When his father Munadi called a policeman involved in the arrest, he heard his son screaming in the background. He was unable to get the help he needed from other officers, including Mr Santoso, who is reportedly the second highest detective in command at the North Jakarta Police Station.

Two days later Munadi was told that Bayu was dead: shot by the police after he tried to escape during a crime scene reconstruction.

However in the hospital later that day he found his son's corpse covered with other wounds, including gaping wounds on his wrists and hands and more than 10 stab wounds on his legs. They were not wounds, he says, of a man who would be able to run away.

This case demonstrates the abuse of power by police officers while conducting arrests and holding suspects in detention. It further illustrates how the numerous flagrant human rights violations by police coming out of this area is deeply institutionalised and needs urgent, close attention.
This case is a blatant example of the futility of the Indonesian governments ratification of the United Nations Convention Against Torture in 1998. It should be noted that Indonesian citizens have every right to be protected from disproportionate police action while being interrogated as suspects. Furthermore the suspected person has every right to file a lawsuit concerning the lawfulness of his/her detention as well as any physical action that could be deemed as disproportionate when conducted in the period of apprehension and/or detention.

I call for an immediate investigation to be conducted into the operation of the North Jakarta police station and the station involved in Bogor, West Java, where it appears that torture and summary executions are condoned and carried out by staff. This situation points to a shocking over confidence among police in their own impunity, and a disregard for law, justice or due process among law enforcers. This action is important to secure the impartiality, transparency and accountability of police authority in the country. In this respect, the National Human Rights Commission and the National Police Commission must also play a part in ensuring that the victims receive proper redress, and that police officers are trained to understand their legal powers and respect human rights laws.

Please also be informed that the Asian Human Rights Commission has written to the UN Special Rapporteur on the question of torture and on extrajudicial, summary or arbitrary executions informing him of this case.

1 July, 2009 - Previously secret U.S. State Department documents implicate the President of Indonesia in a probable cover-up of an ambush in West Papua. The documents show Susilo Bambang Yudhoyono, who is running for reelection on July 8, maneuvering behind the scenes to manage the investigation into the August 2002 murder of three teachersone Indonesian and two U.S. citizens.

Yudhoyono brought politics into a case that should have just been about forensic facts, said Dr. Eben Kirksey, an anthropologist at the University of California, Santa Cruz and a regional specialist. The documents reveal that Yudhoyono initially stalled attempts by the FBI to launch an independent investigation, he continued. The U.S. Congress, outraged at these stalling tactics, blocked funds for Indonesian military training until there was cooperation with the FBI.

The documents released today add a new twist to a hotly contested Presidential race.

Yudhoyono is not the only controversial former soldier running in the presidential election, said John M. Miller, National Coordinator of the East Timor and Indonesia Action Network. Vice presidential candidates and former generals Wiranto and Prabowo Subianto were involved in well-documented human rights crimes in East Timor and throughout Indonesia.

When a police investigation implicated Indonesian military shooters as the likely murderers of the schoolteachers, Yudhoyono became involved. Yudhoyono, a retired General and then the Coordinating Minister of Political and Security Affairs, wrote to the Charge D'Affaires of the U.S. Embassy in Jakarta that I have dispatched a fact finding team led by one of my deputies to Timika and its surrounding (sic), to find additional information and other related facts especially on a broader political and security aspects of the incident. Timika, the site of the attack, is in the remote province of Papua, where U.S. mining giant Freeport McMoRan (FCX) operates a concession.

Yudhoyonos stalling tactics let the Indonesian military cover their tracks, said Paula Makabory, a Papuan human rights activist who founded the Institute of Papuan Advocacy and Human Rights in Australia.  The fact finders under his command systematically intimidated witnesses and tampered with material evidence, Makabory continued.

Following high-level negotiations with Bush administration officials, who promised Indonesia millions in military aid, Yudhoyono allowed the FBI into his country. "By the time the FBI were granted access the trail was cold," said Makabory.  The FBI investigation proceeded within a narrow framework that fit the Bush administration agenda, said Dr. Kirksey.

The Special Agents found a fall man, while tiptoeing around evidence connecting their man to the Indonesian military, Kirksey added.

Antonius Wamang, an ethnic Papuan, was indicted by a U.S. grand jury for his role in the attack. He was apprehended in 2006 by the FBI and sentenced to life in Indonesian prison. Wamang had extensive ties to the Indonesian military, according to a peer-reviewed article, Criminal Collaborations, co-authored by Dr. Kirksey and Andreas Harsono, an Indonesian investigative reporter (link below).

The declassified documents disclosed today were obtained through a Freedom of Information Act Request (FOIA) by Dr. Bradley Simpson of the National Security Archive. The State Department found 62 documents relevant to the Timika murders. They released only two of these documents in full and 20 others with excisions. The rest were withheld. The FBI did not release any documents, writing: No records responsive to your FOIA request were located by a search of the automated indices. The FBI is notorious for not complying with Freedom of Information Act requests.

1) Response by the State Department and the FBI to the Freedom of Information Act (FOIA) Request

2) Initial Reports About Attackers; Yudhoyono Orders a Quick Response The first State Department reports about the 2002 attack seriously entertained two theories: that the perpetrators were Papuan independence fighters (OPM guerillas) or rogue elements of the Indonesian military. The documents note that the assault took place on a foggy mountain road near a military checkpoint and an Army Strategic Reserve Forces post. Upon learning of the attack, Yudhoyono ordered a quick response to restore security and to investigate the attack.

The U.S. Embassy noted in a cable to Washington: Many Papuan groups are calling for an independent investigation led by the U.S. Calls for an independent probe are unrealistic, but we believe that Papua's Police Chief, who enjoys a good reputation with Papuan activists (and U.S.), can conduct a fair investigation. The Police Chiefs investigation later indicated that the Indonesian military was involved. The FBI subsequently launched a separate probe.

3) Attack Victims Treated in Secrecy at Australian Hospital

The survivors of the assault were airlifted out of Indonesia to a hospital in Townsend, Australia. 4) Yudhoyono Assumes Coordinating Role in Investigation

Following police reports of Indonesian military involvement, these documents reveal that Yudhoyono began to play a more active role in managing and influencing the direction of the investigation. Yudhoyono met repeatedly with the FBI field investigators, as well as high-level U.S. diplomats, blocking their initial attempts to gain unmediated access to witnesses and material evidence. This file includes a letter from Yudhoyono to the Charge D'Affaires of the U.S. Embassy where he outlines a strategy for managing the broader political and security aspects of the incident.


5) Commander-In-Chief Concerned About Washington Post Interview

The Washington Post reported in 2002 that senior Indonesian military officers, including armed forces commander General Endriartono Sutarto, had discussed an unspecified operation against Freeport McMoRan before the ambush in Timika. General Sutarto vehemently denied that he or any other top military officers had discussed any operation targeting Freeport. He sued The Washington Post for US$1 billion and demanded an apology from the paper. Several months after this lawsuit was settled out of court, The Washington Post asked to interview Sutarto. 6) Most Important Issue in U.S.-Indonesia Bilateral Relationship

The U.S. Ambassador stressed in a June 2003 meeting with Yudhoyono that justice in the Timika killings was the most important issue in the bilateral relationship. During this period, FBI agents were given intermittent access to evidence. Yudhoyono continued to play an active role in coordinating the political aspects of the investigation. Taking an unusual personal interest for someone with a Ministerial level position, Yudhoyono repeatedly met with the FBI case agents the low-ranking U.S. investigators who were deployed to Timika for field investigations.

7) Attorney General Ashcroft Suppressed Evidence

On June 24, 2005, Attorney General John Ashcroft and FBI Director Robert Mueller announced that Antonius Wamang, an ethnic Papuan, was indicted by a Federal Grand Jury for the Timika murders. The indictment alleged that Wamang was a terrorist who sought independence from Indonesia. Following this announcement, three respected human rights groups and indigenous organizations charged that the U.S. Government suppressed evidence linking Wamang to the Indonesian military. United Nations security forces will be replaced by Indonesian security forces after the first phase of the UNTEA administration. All United Nations security forces will be withdrawn upon the transfer of administration to Indonesia ( Article XIII).
 
After the transfer of full administrative responsibility to Indonesia, Indonesian national laws and regulations will in principle be applicable in the territory, it being understood that theybe consistent with the rights and freedoms quaranteed to the inhabitants under the terms o the present of agreement. New laws and regulations or amendments to the existing ones can be enacted within the spirit of the present agreement. The representative council will be consulted as appropriate ( article XIV)

Security officers Indonesian Conducting operation in  Mentembu Villages,
Suspected as a being base for the OPM movement

  Serui July 12, 2009. RI security apparatus (consisting dair TNI troops and police) in the community suspect Yapen WAROPEN  regency in Mentembu villages Organization is the basis for movement Papua Merdeka (OPM), so that at 11:00 yesterday, 11 July 2009 Indonesian security apparatus to do this operation around the village. Security officer shot this release for those who are suspected as the OPM in the village of Mentambu. Due to the presence of the security apparatus in villages makes a number of people in the village to fight against the military and police forces. TNI troops and police arrested  and hold a number of people in the village including the school children who had just come home schools. A number of houses owned by residents in the fuel by the security apparatus.

  The Indonesian security apparatus using the momentum to attack the security PILPRES village, this village operation  not only occur at the time but this also happens during the legislative elections, with the same reason, namely the security of legislative elections, so that the security apparatus to conduct operation village.

  Due to this incident the people in Mentembu villages  sense of fear and some have fled from the village to seek safety. Until this news was revealed in villages conditions that have not been known by various parties. Society Serui situation in society is difficult to access by some  parties, so that almost every event against the repressive local people to access very difficult to know.

  Here is the people arrested by the police Yapen WAROPEN among others:

Mr. Polikarpus Ambokari (37 years, Farmer), Hans Mandoman Ambokari (40 years old, farmer), to own two houses in the fuel burn by aparat.Priliati Uruwaya (26 years, NGOs) and Niko Kamare (17 years) of junior high school students grade 3, Ari Ambokari (17 years) of junior high school students, Carles kafiar (15 years) grade 3 of junior high school students, and Ambokari Akon (13 years), grade 1 of junior high school students, children, school is just home school, but these children are arrested by the police (Yapen WAROPEN)

Dear Rt Hon Andrew Smith MP and All Members of IPWP Around the World.

First we want to thank you on behalf of the people of West Papua for your support of the International Parliamentarians for West Papua. This is a very significant step on the road to justice and freedom in West Papua. This is the first time the people's voices in West Papua have been heard at this level and as a result spontaneous demonstrations broke out across West Papua celebrating the formation of the group.

We are however sad to have to inform you of the deteriorating human rights situation in West Papua over the last six months and we hope you will be able to help us in bringing attention to this issue.

As a result of the demonstrations in support of the launch of the IPWP, two students have been arrested and mistreated. One of them, Bucthar Tabuni has just been sentenced to three years in prison. Fifteen people are being detained and face possible life sentences for demonstrating in support of the launch of the International Lawyers for West Papua. We are currently aware of over fifty political prisoners being held across West Papua for voicing their opinions in support of West Papuan independence and attending peaceful demonstrations. A recent Human Rights Watch report has raised serious concerns about the systematic torture of prisoners. To add to this, the Indonesian military are currently carrying out sweeping operations in the highlands, burning houses, raping and displacing people into the jungle. Attached is a document summarising the current situation with links to further information.

These developments fly in the face of Indonesia's claims to be improving their human rights record. Foreign governments continuously claim that Indonesia is working hard in this area but on current evidence we can see that this is not true. Despite the claims of systematic torture reported by Human Rights Watch the Indonesian Ministry of Justice and have decided not to make any investigations.

We would like to ask you to make a collective response to this situation, by writing to the Indonesian government calling on them to release political prisoners, withdraw military from the highlands, investigate reports of torture and to allow access into West Papua for the International Red Cross and foreign journalists. We are asking all supportive Parliamentarians to lobby your governments to put pressure on Indonesia to improve the situation urgently, and are inviting members of International Parliamentarians for West Papua to put their names to the statement below, also set out on the IPWP website. You can put you name to this statement by emailing humanrights[at]ipwp.org (changing [at] for @).

Please also remember these problems all stem from the denial of the West Papuan's right to self determination and this fundamental problem still needs to be resolved. Please continue to support this cause and circulate the attached document to highlight the current situation to other politicians and encourage them to sign up to the International Parliamentarians for West Papua.

Indonesia's Special Forces (Kopassus), more than any other in the Indonesian military, stands accused by the Indonesian people of some of the most egregious human rights violations.

The history of Kopassus human rights violations, its criminality and its unaccountability before Indonesian courts extends back decades and includes human rights and other crimes in East Timor, Aceh, West Papua and elsewhere. The crimes of Kopassus are not only in the past. A recently published Human Rights Watch report details ongoing Kopassus human right violations in West Papua.

In 2008, the Bush administration proposed to restart U.S. training of Kopassus. the State Department legal counsel reportedly ruled that the ban on training of military units with a history of involvement in human rights violations, known as the Leahy law, applies to Kopassus as a whole.

STATEMENT: INTERNATIONAL LAWYERS FOR WEST PAPUA

The International Lawyers for West Papua are deeply concerned at the
arrests, detention and apparent torture of West Papuans by the
Indonesian Government.

By its actions the Indonesian Government is once more violating
international law, specifically the fundamental human rights guaranteed
by international law.

Article 19 of the International Covenant on Civil and Political Rights
states that:

1. Everyone shall have the right to hold opinions without interference.
2. Everyone shall have the right to freedom of expression; this right
shall include freedom to seek, receive and impart information and ideas
of all kinds, regardless of frontiers, either orally, in writing or in
print, in the form of art, or through any other media of his choice.
3. The exercise of the rights provided for in paragraph 2 of this
article carries with it special duties and responsibilities. It may
therefore be subject to certain restrictions, but these shall only be
such as are provided by law and are necessary:
(a) For respect of the rights or reputations of others;
(b) For the protection of national security or of public order (order
public), or of public health or morals.

Freedom of expression covers the right to voice support for
organisations such as the International Lawyers for West Papua, which is
dedicated to upholding the rule of international law through peaceful
means. General Comment 10 emphasises that any restriction on the
exercise of freedom of expression must be provided by law, must be
"necessary," and must not put the right itself in jeopardy.

Indonesia acceded to the Covenant on Civil and Political Rights in
February 2006 and is therefore legally bound to allow West Papuans to
express their views peacefully.

Article 21 of the Covenant on Civil and Political Rights guarantees the
right to peaceful assembly and therefore protects the right of West
Papuans to demonstrate peacefully in support of their views. Indonesia
is in breach of this obligation by arresting and detaining demonstrators.



Freedom of expression and freedom of assembly are the basic freedoms of
a democratic country. We are very concerned about the fifteen people on

We are also deeply concerned about the reports of torture of political
prisoners. Torture is a crime against humanity and is prohibited by
international law in all circumstances.

We therefore respectfully request the Indonesian Government to

- Release immediately all political prisoners;
- Take immediate steps to ensure that all West Papuans are able to
exercise their fundamental human rights under international law without
reprisals, fear or threats;
- Permit a credible international organisation to conduct an independent
enquiry into the allegations of torture.

There can be no peace in the world unless all states, including
Indonesia, respect the inherent dignity of mankind and actively protect

Yawan Wayeni Shot Dead By Indonesian Police in Serui

Serui, [opeem] - A member of TPN/OPM region Serui, Yawan Wayeni (39) shot dead by Indonesian Police of Yapen Island at 4.00 A.M, Monday morning. His body found at garden near Mantembu village after Indonesian Police shot at stomach and foot.

Our informan in Serui said, Indonesian Police very brutal on attach. Many residents of local indigenous people escaped to the juggle. The TPN/OPM region Ferdinand Worobay said, the coloniser Indonesia is our enemy, so are West Papua people. We will fihgt for our independence, add Worobay told to the informan.

The body of Yawan has been buried last night (Monday Night). The wife and the child of Yawan were kept by police and still questioned.

Meanwhile, Victor F. Yeimo, chariman of West Papua National Committee in Jayapura said that it was long political conflic between West Papua people and Indonesia with it's militaty forces.

"The conflict will result in casualties of many peoples of Papua. the international side must take the action towards the practice of the colonisation that was carried out by Indonesiain West Papua", said Victor.

TPN OPM In Yugum Bolakme Start to Fight

Wamena, [opeem]- TPN OPM Kodap II (the name was according to the TPN/OPM deviding teritorial) Yugum, Wamena also began the opposition action. The group headed by Etius Tabuni in this territory succeeded in carrying out the attack and occupying the Bolakme District since last July 26 2009. They severed bridge that connected 3 regencies, namely the Regency Puncak Jaya, Tolikara and Mamberamo Tengah.

This Sunday, they were attacked by the join of TNI/POLRI, but troops of TPN/OPM were successful attacked retreated troops of TNI. Regent Wamena Jhon Wempi Wetipo who came with the TNI strength did not succees entering their post. Etius Tabuni as the Commander of the Replacement of the Petrus Tabuni that was killed by the TNI in the PNG-RI Border 2005 then stated that they carried out the attack to maintain the nation people of West Papua from the threat of all the practices of the colonisation that was carried out by Indonesia in West Papua.

He also stated, they will continue to struggle with the strength of the arrow and the bow until receiving the sovereignty right of politics as a country. Cenderawasih Pos (a local news paper) edition on August 1 2009 wrote Regent Jhon Wempi Wetipo and the TNI/POLRI will carry out the meeting to attack to the defence of TPN/OPM .

The Exchange of Fire Between TPN/OPM and the TNI Continued

Timika, [opeem] -TNI POLRI and Densus 88 continued to carry out the pursuit against TPN/OPM headed by the Kelik Kwalikin Timika West Papua. The exchange of fire between TPN/OPM and the TNI continued to happen. It Was not far from the central Post of TPN/OPM in Mimika, the TNI succeeded in entering through Agimuga sea with 4 speed boats strengths. However, several eyewitnesses there said the 4 speed boats got acident and sank.

From the central post was reported by the TNI and POLRI's troops carried out the slaughter against several residents in the settlement that was not far from Mimika. TNI and POLRI also planned to carry out the air attack on villages that were suspected by them as the basis and the post of TPN/OPM headed by the Kelik Walik.

Gen. Kelik Kwalik in the press release said that he will continue to struggle to the end of the life. He also stated Kopasus killed Drew Nicholas Green, the Australian resident and deliberate accused TPN/OPM of covering their rotten intention. Until now TNI operation still continued.

Shocking images have emerged showing the devastation caused by an
Indonesian military sweeping operation last week in the Bolakme area,
close to the West Papuan highland town of Wamena.

Over 500 Indonesian troops stormed the area, opening gunfire fire on
civilians, burning down 25 houses, killing livestock and raping
women. Those that managed to flee remain in hiding in the jungle.

INDONESIA: 113 villagers hunger deaths caused by government neglect as well as harvest failure in Yahukimo, Papua

ISSUES: right to food, right to health; agriculture; famine

Dear friends,

The Asian Human Rights Commission (AHRC) has received information from human rights groups working in Yahukimo that since January 2009 till now approximately 113 villagers in Yahukimo, Papua, died of hunger associated with diseases. The harvest failure this year caused by climate change resulted in deaths which aggravated lack of food in the villages. It affected seven districts including Suntamon, Langda, Bomela, Seradala, Walma, Pronggoli and Heryakpini and 26 sub-districts. The affected areas had already suffered the deaths of 55 villagers from starvation due to harvest failure in 2005. The government however failed to improve agricultural facilities in order to ensure food security since then.

CASE DETAILS:

According to information collected by Indonesian Social Services Christian Foundation (Yayasan Kristen Pelayanan Sosial Masyarakat Indonesia; YAKPESMI), bad weather and heavy rain have severely affected the Yahukimo recency of Papua, especially from May until August. This has caused residents harvests to fail. The scarcity of food has led to an increase in diseases, such as malaria and diarrhea.

The number of people that have died of starvation in Yahukimo regency has reached 113 since January 2009; more than 31 people had died in Langda, 34 in Bomela, nearly 20 in Seredala and 10 in Suntamon. According to Yuliat Iksomon, the head of the Yahukimo disaster response team, deaths caused by starvation also happened in another three districts of Yahukimo; Walma, Pronggoli, and Heryakpini. In Walma district itself, it is reported that as many as 60 people have died of starvation associated with diseases.

The government has denied that there is a lack of food which has lead to villagers dying of starvation. It was published that the Secretary of Yahukimo administration Mr. Robby Langkutoy as well as the Ministry of Social Welfare, have denied the villagers died of starvation but rather from diseases and failed harvest. Conversely, in recent days, Ones Pahabol, the chief of Papua's Yahukimo regency, announced that the villagers in 26 sub-districts were starving due to the failure of the sweet potato harvest, which is the main staple food in the area.

On 14 September 2009, the central government sent food aid of 100 tons of rice, sweet potatoes and other foodstuffs including noodles to the effected area. However, despite the fact the government has admitted the villagers suffered from various diseases, medical aid has not yet reached the villagers.

BACKGROUND INFOMRATION:

Even before 2009 the villagers in Yahukimo regency were suffering from extreme poverty and lack of facilities and resources for food security. However, the government has ignored their living circumstances and has not paid particular attention to the dire circumstances of the village communities.

In 2005, it was reported that 55 people had died of starvation due to harvest failure. The government accepted that there had been a failure of the harvest due to bad weather, but refused to accept that people are dying due to starvation. Instead it insisted that disease and lack of food due to a failed harvest were the main causes of death, not starvation.

Despite this, twelve food storage facilities were constructed in 2006 to assist those that had suffered from crop failure. Unfortunately, this was not effective in preventing starvation and did not ensure food security, as the storage facilities were not suitable for storing sweet potatoes the staple food in the region. It was also claimed that the Ministry of Social Welfare, in 2006, distributed good quality seeds free of charge in Yahukimo. This happened only once.

Many villagers live in high land areas; Yahukimo is remote and isolated. Daily food sources come from home grown produce such as sweet potato or potato. If villagers fail to harvest enough produce to support their families, they immediately face starvation. While finding it difficult to harvest sufficient food, the villagers can eat only one meal a day. Although villagers collect vegetables and fruits from the forest, it is not enough for them to be free from hunger. The lack of infrastructure such as roads or public transportation in Yahukimo also aggravates food insecurity.

It is widely accepted that malnutrition or starvation affects the immune system of the human body, which then leads to diseases such as diarrhea, wasting, or breathing difficulty among other things (Please refer to the AHRC statement for more information on malnutrition and diseases). Any analysis which does not consider the extremely poor living conditions of these villagers will only expose the superficial symptoms. The denial, by the government, of a proper investigation into this situation and a lack of professional knowledge is irresponsible.

Furthermore, along with the governments denial of starvation deaths, they are reluctant to detail exact information of the deceased villagers. Children, who are more vulnerable to malnutrition and diseases, need urgent medical attention. However, no accurate information about the children has been revealed. It is also extremely concerning that the deaths were disclosed several months after they occurred. To prevent further deaths and ensure food security the government should undertake a full investigation into the deceased villagers, detailing information such as age, gender, symptoms of sickness, living condition and food intake before the death.

ADDITIONAL COMMENT:

The right to food is a fundamental right of each Indonesian person. It is enshrined in the Act of the Republic of Indonesia Number 7 of 1996 on Food. The Act also states that sufficient availability of safe, nutritious and quality food is a main pre-requisite which must be met in the effort to establish a system which provides adequate health protection, and plays a larger role in increasing the prosperity and welfare of the people.

Section 17 of Article 1 in Chapter 1 says,

Food security is the condition in which the fulfillment of food for the households is reflected by the availability of sufficient food both its quantity and quality, safe, evenly distributed and within reach.

As is evidenced in the deaths by starvation in Yahukimo, food is not available for the villagers. This is the most basic entitlement in the right to food according to the Act as well as international law. Food aid is necessary for initial emergencies but is crucial to preventing future emergency situations from arising. Despite the numerous deaths by starvation in Yahukimo since 2005, the government has failed to ensure the right to food in the long term by not establishing an adequate food system. As a consequence the neglect and denial of the government has led to more deaths through starvation this year. This is a serious violation of the right to food.

As a state party of International Covenant of Economic, Social, and Cultural Rights (ICESCR), the Indonesian government has an obligation to take steps with a view to achieving progressively the full realization of the rights in ICESCR, including right to adequate food as enshrined in Article 11 paragraph 1 of ICESCR.

Article 11 paragraph 2 of the ICESCR also clearly states that, "The States parties to the present Covenant, recognizing the fundamental right of everyone to be free from hunger, shall take, individually and through inter needed: a) To improve methods of production, conservation, and distribution of food by making full use of technical and scientific knowledge, by disseminating knowledge of the principles of nutrition and by developing or reforming agrarian systems in such a way as to achieve the most efficient development and utilization of natural resources; b) Taking into account the problems of both food importing and food exporting countries, to ensure an equitable distribution of world food supplies in relation to need".

Please write a letter to express your deep concern about starvation deaths in Papua, Indonesia. The AHRC has also written a separate letter to the UN Special Rapporteur on Right to Food calling for intervention into this case.

I am writing to voice my deep concern regarding 113 villagers died of starvation associated with other diseases in seven Districts located easternmost province in Papua since January 2009.

The number of people that have died of starvation in Yahukimo regency has reached 113 since January 2009; more than 31 people have died in Langda, 34 in Bomela, nearly 20 in Seredala and 10 in Suntamon. According to the head of Yahukimo disaster response team, Yuliat Iksomon, death caused by starvation also occurred in another three districts of Yahukimo regency, which are Walma, Pronggoli, and Heryakpini. In Walma district itself, it is reported that as many as 60 people have died of starvation associated with other diseases.

I am informed that the villagers in affected areas have been suffering from lack of food and resources for years. The villagers face starvation deaths every year, of which the number went up to over 100 in this year alone. It is reported that the deaths by starvation was caused by the failure of agricultural production, which is the only food resource in the villages. However, I am of the opinion that the neglect of the government as well as failure of building a food security system is the main reason exacerbating starvation deaths. I reach this conclusion thus;

First, the government has already experienced starvation deaths in affected areas since 2005. I have learned that the government then denied the deaths by starvation and stated that the deaths were caused by harvest failure. The government somehow took an action to provide a facility for food storage and good quality seeds in 2006. However, the efforts the government made were inefficient and temporary. Since then, the government has been ignoring the production failure often affected by climate change and has not paid attention to the deaths of starvation that have happened each year.

Second, the affect villages - remote and isolated areas - are extremely limited in food resources. Villagers merely depend on the sweet potato or potato harvested for their main food source. Most of the villagers do not have any other livelihood to obtain daily food. Once they failed to harvest sufficient food products, they immediately face starvation. Although they collect vegetables or fruit from the nearby forest, it is not enough to ensure they are free from hunger. I am informed that many of the villagers found it difficult to obtain two meals a day this year. In fact, the main food product is not nutritious enough to ensure the right to adequate food. Furthermore, I am very concerned as to how the children are obtaining sufficient and necessary nutrition for their growth.

Thirdly, there is an absolute lack of basic infrastructure in affected areas. Some areas can be approached only by air transportation, others can not even manage public transportation due to lack of road. For those who want to get rice or other foodstuffs at the market in town, the transportation fee is much higher than the price of rice. Moreover, it makes it difficult to provide food aid for the affected areas.

Forth, the harvest failure can be overcome by appropriate food distribution and investment for agriculture for which the government failed to do. Once the government identified the vulnerable areas of food security, they can improve the agricultural production and prevent the death of starvation by building up the system to ensure the right to food. The harvest failure is not a satisfactory or adequate excuse for the government to justify its neglect.

I am also informed that the government has denied that the villagers died of starvation and further have been reluctant to detail exact information regarding the deceased villagers. The government's official analysis on the cause of deaths both in 2005 and in 2009 exposes its lack of common knowledge and responsible attitude. The harvest failure in the villages leads to lack of food and starvation resulting in deaths. It is unreasonable to say that the villagers died not of starvation but failure of harvest. The analysis without consideration of extremely poor living condition only diagnoses the superficial symptoms.

The irresponsible attitude of the government is also reflected in the fact that the death was disclosed only several months after they occurred. To prevent further deaths and to ensure food security, the government should make a transparent investigation into the deceased villagers detailing information such as, age, gender, symptoms of sickness, living condition, food intake before the death etc.

Learning from the ineffective government action in the past, I am afraid that this reported case of the starvation particularly in regions such as Papua or West/East Nusa Tenggara might only be the tip of the iceberg. It is often told that the starvation and malnutrition cases take place in those areas, but no substantial action is taken by the government.

I am aware that the Right to food is a fundamental right of each Indonesian person. It is enshrined in the Act of the Republic of Indonesia Number 7 of 1996 on Food. The Act also states that sufficient availability of safe, nutritious and quality food is a main pre-requisite, which must be met in the effort to arrange a system which provides for health protection and to play a larger role in increasing the prosperity and welfare of the people. As it is shown in the villagers deaths in Yahukimo, there is neither availability of food, which is most basic food security entitlement, nor effective action taken by the government.

I am further informed that on 14 September the central government sent food aid of 100 tons of rice, sweet potatoes and other foodstuffs including noodles. Despite the fact that the government admitted the villagers suffered from various diseases, medical aid has not yet reached the villagers. Food aid is absolutely necessary for emergencies at the first stage. It is further demanded that the government take positive and long-term action to construct a system for food security.

I am also aware that as a state party of International Covenant of Economic, Social, and Cultural Rights (ICESCR), the Indonesian government has an obligation to take steps with a view to achieving progressively the full realization of the rights in ICESCR, including right to adequate food as enshrined in Article 11 paragraph 1 of ICESCR.

In light of the above, I strongly urge you to take immediate action to prevent more deaths by starvation and to ensure food security in Yahukimo like below:

1. Conduct a transparent investigation into the deceased villagers and the current situation in particular regarding children;
2. Immediately provide sufficient and nutritious food and medical aids;
3. Provide special attention in affected areas with a system ensuring sufficient agricultural products;
4. Construct basic infrastructure such as roads or public transportation in order to assist and promote food security, and
5. Provide agrarian education system for the villagers to strengthen their skill and capacity as well as necessary facilities to prevent failure of harvest.

What's happening in West Papua ?
  • There is widespread torture and abuse of political prisoners in West Papua, according to Amnesty International and Human Rights Watch.

British filmmaker Dominic Brown travelled without the knowledge or authority of the Indonesian authorities in order to film Forgotten Bird of Paradise. The documentary provides a rare and moving insight into the forgotten struggle for independence that has gripped West Papua for over 45 years. It includes never before seen footage of OPM rebel fighters at their stronghold deep in the Papuan jungle, as well as interviews with human rights victims of the Indonesian regime. 
Most startling of all is an interview conducted with the Amnesty International recognised ‘prisoner of conscience’ Yusak Pakage. He is currently serving a 10 year prison sentence for peacefully raising the West Papuan flag. 

The interview with Pakage was recorded in secret during a hospital visit where he was receiving treatment for torture. The documentary also provides an insight into recent developments on the international arena including the launch of the International Parliamentarians for West Papua which has seen a number of influential politicians from around the world come together to coordinate international action against the ongoing occupation and bring about means whereby the West Papuan will eventually gain their long lost right of self-determination.


Frequently breathtaking and thought provoking, the footage that makes up Forgotten Bird of Paradise provides a remarkable insight into a forgotten world where ancient traditions and cultures live on into the modern age. Above all it shows the inspiring resilience of a people who have suffered so much under Indonesian occupation, but whose dream for freedom burns stronger now than at any time in history. Dear friends,

The Asian Human Rights Commission (AHRC) continues to receive reports of violence being wrought by soldiers and police against civilians in remote West Papuan villages. In the latest case a joint operation responded to an illegal flag raising by the banned Free Papua Movement with indiscriminate violence against civilians. Soldiers have reportedly burned 30 houses, killed livestock and shot threateningly around local residents, many of whom took refuge in the forest for a few weeks out of fear. In another case a man was shot in the stomach and died before reaching the hospital. Complaints to the local and central offices of the national human rights commission have not been taken up.

CASE DETAILS:

In July members of the Free Papua Movement (OPM) reportedly raised the West Papuan flag and the United Nations (UN) flag in the yard of a house in Jugum village, which is in the Bolakme district of the Jaya Wijaya Regency. The Papuan flag is known as the Morning Star (pictured here) and is banned in Indonesia due to its association with pro-Independence resistance groups (see more on this below).

On 3 August local OPM members were approached by representatives of the government, religious leaders and the Jaya Wijaya district police to discuss lowering the flag, and a meeting was held with members of local human rights NGOs and the local tribal council. However no compromise was reached.

On 5 September at around 5am, armed soldiers and police officers arrived in the village from Wamena to conduct a 'sweeping operation' (a targeted operation to intimidate, usually involving the destruction of property) against the OPM, but they found neither the members nor the flags. However according to witnesses they proceeded to set 30 houses alight (pictured above, right and here), seemingly at random, and shot four pigs. They then threatened villagers with bursts of gunfire, scaring many of them into the surrounding forest. Some of the residents remained in the forest for two weeks out of fear, and many fell sick due to the lack of food and medical treatment. The bullets were later collected by the residents (pictured below) as evidence.

The AHRC has recorded various violations that have occurred during these kinds of sweeps, and continues to hear of others. On 11 July 2009 in Mantembu and Yapen villages (Yapen regency) civilian houses were also reportedly burned, and one local resident was shot in the stomach. Yawan Wayeni (39) was suspected of being involved in a ceremony in which the Morning Star was raised, and he died before reaching the hospital.

Several local human right organisations have protested and submitted complaints to the National Commission for Human Rights (Komnas HAM) and the Papuan Branch of the Commission for Human Rights. However no thorough investigations have been conducted into any of these incidents.

BACKGROUND INFORMATION:

Tens of thousands Papuans are reported to have died in military operations since the province was annexed by Indonesia the sixties (some sources claim up to 200,000 have been killed around 10% of the Papuan population), and there is a widespread fear of soldiers among indigenous villagers. Papuan villages are remote and their residents enjoy little access to institutions of justice. However violations are also taking place in towns and cities. On 16 March 2006 a sweeping operation was carried out against university students in Abepura by police and the military and students from several Pegunungan Tengah regencies were evicted from their dormitory because they were suspected of being involved in an attack against a local police office. Operations were conducted in 2003 and 2005 in several districts (Tinginambut, Yamo, Mapenduma, Kywagi, Bolakme and Serui) resulting in the burning of homes and churches and the destruction of crops.

These kinds of actions lead to chronic food shortages and other hardships and have resulted in increased calls for autonomy - and independence - in this resource-rich province. Inequality remains a pressing issue. The autonomy law has been in effect since 2001 but has not resulted in an improvement of living conditions or political freedoms for Papuans. Efforts by the administration in Jakarta to better the situation tend to flounder due to the strong grip the military holds on the area's resources, and because of corruption on the local government level.

ADDITIONAL COMMENTS:

It is evident from the cases above that the Indonesian government is not following through with its guarantees to protect human rights in West Papua. As a member of the UN, Indonesia is committed to respecting the international human right instruments, including the Universal Declaration of Human Rights (UDHR: particularly article 3, article 8, article 9) and the International Convention on Civil and Political Rights (ICCPR), to which it is a state party. Article 2.3 entitles everyone to effective remedy, while the AHRC would like to highlight article 6, the right to life; article 7, freedom from torture; article 15, presumption of innocence; article 16, equality before the law; and article 18, freedom of expression, freedom of religion and freedom of choice.

On a national level, the right to protection is protected by the constitution, especially in article 28 B p.2 and article 28 G p.1, and in domestic legislation such as article 29 p.1 and article 30 of law no. 39 of 1999

Furthermore, earlier this year the Chief of the Indonesian National Police enacted the new Regulation of the Chief of Indonesian National Police Number 8 of 2009 which deals with the implementation of human rights principles and standards in the discharge of the duties of the Indonesian National Police. Indonesia also has Law number 34 of 2004 for the Indonesian National Army (TNI), particularly article 2 p.d (on TNI professionalism and respecting of democracy, civil supremacy and human rights) and article 5 (on the roles, functions and duties of the army).

Furthermore it should be noted that for a short time in 1961 and 62 the Morning Star was the national flag of West Papua, and has emotional significance for many Papuans. Under international law the expression of political opinions in the display of a flag or any other non violent form should not be considered a crime. The AHRC condemn the imprisonment of political activists and their continued persecution, as reported in previous appeals: UAU-004-2009, FUA-008-2009 and UAU-071-2008.

SUGGESTED ACTION:

Please send letters to the authorities listed below to call for an immediate investigation regarding TNI and police violence during raids, urging disciplinary and legal action against those found to be involved.

The festival, which is now in its fourth year, strives to raise the

THE LAUNCHING OF THE INTERNATIONAL PARLIAMENTARIANS FOR WEST PAPUA PNG CHAPTER
In light of the Launching of the International Parliamentarians for West Papua in London on 15th October 2008, of which I am a founding member, I am pleased to announce the launching of the International Parliamentarians for West Papua The PNG Chapter on Saturday 07th of November 2009 at the University of Papua New Guinea Botanical Garden.
The International Parliamentarians for West Papua is a concern international Parliamentarian group of legislators who simply want the people of West Papua to exercise the fundamental right to self determination just like all other people of the world because that right belongs to the people of the world.
The main purpose of the International Parliamentarians for West Papua is to advocate for and ensure that our people of West Papua exercise their fundamental rights to self determination, a right recognized globally and enshrined in the United Nations founding Charter and in the preamble of the United Nation Human Rights Charter.
The right to self determination is recognized globally as a fundamental right to be exercise by people of the world.  It is also recognized as a preliminary right that must be exercised and enjoyed before one can benefit or achieve other rights such as social, economic or political rights.  The right to self determination is therefore a prerequisite or fundamental to all other rights and history shows that the people of West Papua did not exercise that right to date.
The launching of the PNG Chapter is complementary to the efforts of the International Parliamentarians in Europe and USA in recognizing the right of the West Papuan people to self determination, that has been denied from them through the 1969 Act of Free Choice.
The launching of the International Parliamentarians for West Papua PNG Chapter is a show of support and commitment to the International Community and to the people of West Papua that we stand in solidarity to advocate for self determination for West Papua and by doing so we elevate the plight of the West Papuan People to a new level and hopefully in the United Nations.

Pre-announcement

The documentary film Strange Birds in Paradise A West Papuan Story has been invited to premiere at the International Documentary Film Festival in Amsterdam, IDFA, and 19 29 November 2009. This will be the world premiere.

Go to the films website for details on production, the trailer, and screening information. The website will be updated when new festivals or broadcasts are scheduled.

once the Film Festival circuit is concluded there will be also included a screening kit on the website.

The screening times at IDFA will be scheduled by 10 November 2009. For details you can check on the IDFA website for screening times.

The film's director Charlie Hill-Smith and fellow producers Jamie Nicolai and John Cherry will be in Amsterdam for the screenings, and will be conducting a Q & A session after the film.
